Terms of Service

Last updated: June 2026 — Draft, pending legal review

1. Agreement

These Terms govern your use of the Sapian digital inheritance vault. By creating an account you accept them. You must be at least 18 years old and legally capable of entering into contracts.

2. The service

Sapian lets you store end-to-end encrypted information and designate executors who may receive access according to release rules you configure. Sapian is a technology service: it is not a law firm and does not provide legal, tax or financial advice. Documents generated with our templates may require notarization, witnesses or other formalities to be legally valid in your jurisdiction — consult a qualified professional.

3. Your responsibilities

You are responsible for the accuracy of the information you store, for safeguarding your credentials and encryption passphrase, for keeping executor contact details current, and for ensuring your use complies with applicable law. Because of our zero-knowledge design, losing your passphrase means your encrypted data cannot be recovered by anyone, including us.

4. Plans and payment

Free, Premium (monthly subscription) and Lifetime Legacy (one-time payment) plans are described on our pricing page. Subscriptions renew automatically until cancelled; cancellation takes effect at the end of the current billing period. EU consumers have a 14-day right of withdrawal, which lapses for services fully performed with your consent. Prices include applicable VAT unless stated otherwise.

5. Acceptable use

You may not use Sapian to store or transmit unlawful content, to infringe the rights of others, to attempt to breach security or access other users' vaults, or to evade legal obligations (including the rights of forced heirs under applicable succession law).

6. Vault release

Release of vault contents to executors follows the rules you configure (e.g. inactivity checks, multi-party confirmation). You acknowledge that release mechanisms depend on accurate configuration and reachable executors; Sapian is not liable for releases or non-releases resulting from your configuration choices.

7. Availability and liability

We aim for high availability but do not guarantee uninterrupted service. To the extent permitted by law, our aggregate liability is limited to the amounts you paid in the 12 months before the claim. Nothing limits liability for intent, gross negligence, or harm to life, body or health.

8. Termination

You may delete your account at any time. We may suspend or terminate accounts that violate these Terms, with notice where reasonably possible. Upon termination, encrypted data is deleted in accordance with our Privacy Policy.

9. Governing law

These Terms are governed by the laws of Michigan, USA, without prejudice to mandatory consumer protections of your country of residence. Disputes are subject to the courts of Michigan, unless mandatory law provides otherwise.
